Who actually spoke

The sentence is printed in The Court Today, a 6 October 2026 Registry leaflet numbered ICC-PIOS-TCT-01-164/26_Eng and headed “FACTS AND FIGURES.” It is unsigned. The same sheet names the Registrar, Osvaldo Zavala Giler, lists a United Nations liaison office in New York, and counts 125 States Parties. No Pre-Trial, Trial, or Appeals Chamber signed that line. A public-information inventory is not a judgment of guilt.

On 21 November 2024, Pre-Trial Chamber I rejected Israel’s challenges under articles 18 and 19 of the Rome Statute and issued warrants for Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant. That is a pre-trial act on a prosecutor’s application. It is not a trial. It is not a conviction. The Registry then filed the warrants under “facts.”

What the words do not mean

This wording presents “crimes against humanity and war crimes committed from at least 8 October 2023 until at least 20 May 2024” as a closed account of what was done. The Chamber’s own press account is narrower: it found “reasonable grounds to believe that Mr Netanyahu and Mr Gallant each bear criminal responsibility.” Reasonable grounds is the warrant threshold. It is not proof beyond reasonable doubt. It is not a finding after evidence tested in open court. The Court’s arrests booklet states the limit in the Court’s own voice:

“Without arrests, the judicial process cannot take place, the judges of the ICC cannot make a determination on guilt or innocence and victims cannot be heard.”

Netanyahu and Gallant have not been arrested and have not stood trial. The sheet still writes “committed” across a prosecutor’s date range. Israel is not a State Party. The Jewish Virtual Library records Israel’s rejection of the Court’s claimed jurisdiction over its personnel, and reprints the U.S. position that “the court’s jurisdiction should be reserved for countries that consent to it or that are referred by the UN Security Council.” In August 2025 the State Department sanctioned ICC officials, a step the library records as aimed at the warrant campaign against Israelis. After later appeal litigation, Israel’s Prime Minister’s Office said the process “is political and not judicial.”

What the sheet omitted

The war did not open on 8 October. On 7 October 2023, Hamas-led terrorists murdered about 1,200 people and abducted 251. The Registry’s clock starts the next morning. Hamas still belongs in the first sentence of this war, not as a balancing footnote. The same Court situation includes warrants aimed at Hamas commanders; the Israeli line on the fact sheet treats the massacre as optional scenery around “alleged” crimes already “committed.” NGO Monitor records that the warrants followed years of lobbying by terror-linked NGOs that had already identified the Court as a political instrument against Israel. Israel’s campaign in Gaza was self-defense against an Islamist terror regime that murdered, raped, and took hostages. The Registry took a Pre-Trial Chamber warrant, wrote “committed” across a charging window, and sold it as a fact on a sheet labeled facts.
